Before you are able to make an application for a Non-Molestation Order it is advisable to send a warning letter to the accused first advising him or her that you have obtained legal advice and if his behaviour continues you will have no further option but to take the matter to court. In some cases a letter from a solicitor is enough to stop this behaviour, however in many cases an application to the court is needed for your own protection. An Application can be made on an emergency basis which means the application can be taken to the court that day or the day and dealt with straight away. In many cases of domestic violence the police do not want to get involved and refuse to help. Once you have obtained an injunction, if the accused breaches this then they will be arrested for breach of the injunction.
